  1. Scope of application

The following terms and conditions apply to all orders placed by consumers and business customers via our online shop.

A consumer is deemed to be any natural person who enters into a legal transaction for purposes, which are neither predominantly attributable to commercial or self-employed purposes. A business customer is deemed to be any natural person or legal entity or legal partnership that enters into a legal transaction for purposes that are predominantly attributable to exercising a commercial or independent professional activity.

For business customers, the terms and conditions at hand shall also apply to future business relationships, without us being required to refer back to them in each individual case. If and insofar as a business customer uses conflicting or supplementary terms and conditions, their validity for the contract at hand is hereby expressly objected; such T&Cs shall only be included into a contract subject to our express written consent.

 

  1. Contracting Parties, conclusion of contract

The purchase contract is concluded with Euro-star Reitmoden GmbH.

By offering the products in the online shop, we make a binding offer to conclude a sales contract for these items. You may initially place our products into the shopping cart without any obligation and change your shopping cart entries at any time prior to submitting your binding order by using the tools provided and explained for such purpose during the order process. A binding contract shall be concluded once you accept the offer for the goods contained in the shopping cart by clicking on the order button. You will again receive a confirmation by e-mail immediately after placing an order.

 

  1. Contract language, contract text record

German, English and Dutch are the languages available for concluding a contract.

We will save and store the text of a contract and shall send you the order data by e-mail. You can view the text of the contract via our 'customer login'.

 

  1. Terms of Delivery

The stated product prices are subject to additional shipping costs. Details on the amount of shipping costs are stated in the offers.

We only deliver orders by means of shipments. Unfortunately, collection in person of products is not possible.

We do not deliver to parcel stations.

At euro-star, you can easily and securely pay by card. We accept MasterCard, Visa, and American Express. We will send you a confirmation when your order has left our warehouse. Your card will not be charged until your order has left our warehouse. Your card information is encrypted in our system using SSL technology. This high standard of security means shopping with a card on www.hv-polo.com is safe and secure, and ensures that your data will under no circumstances be accessible by third parties. Extra security for credit card payments: 3D Secure for Visa and MasterCard

To ensure that your online credit card payment is as secure as possible, we use Verified by Visa and MasterCard® SecureCode™, internationally recognized authentication technology collectively known as 3D Secure. 3D Secure protects your credit cards against unauthorized use to minimize the risk of online credit card fraud.

If your card issuer participates in this program, you will be asked to enter an additional password to confirm your identity as the rightful cardholder. After entering your card details and submitting your order, you will be redirected to a page hosted by your card issuer where you can enter your password. If you are not yet registered for 3D Secure, you can do so free of charge in just a few steps during the online order process or contact your card issuer directly to register. Alternatively, you can select a different payment type. The password you select during the registration process is only known by you and your card issuer and is requested with every purchase.

 

What is the CSV/CVV security code?

The security code consists of the last 3 digits printed over the top of the signature field on the back of your MasterCard or VISA card. On American Express cards, the 4-digit security code is printed on the front of the card, to the right above your card number.

 

Paypal

At euro-star you also have the option to pay via PayPal, and can do so, without even creating a PayPal customer account. In order to do this, select PayPal as your preferred payment method during checkout, and at the end of the ordering process you will be directed to PayPal. If you are already a PayPal customer, you can log in with your user data and confirm the payment. However, if you are new to PayPal and would prefer not to create an account, then simply select the option ‘Don’t have a PayPal account?’ (highlighted below) and you can confirm the payment as a PayPal guest. Once the incoming payment is registered with us, your order will be processed. PayPal payments are usually confirmed within a few minutes.

If you return any goods, the amount will be credited to your PayPal account. You can then choose if you want to use the funds through your PayPal account directly, or wish to transfer the amount back to your bank or credit card account. We have no control over this, but you can manage it directly using your PayPal account.

 

Pay after delivery

Klarna is a payment service provider, from Sweden, who take end-to-end responsibility for your payment. They support 60 million consumers worldwide in over 70,000 online stores and are very safe to use.

If you have chosen to Pay After Delivery (with a 14 or 30 day grace period), Klarna will send you an email with further details on how to pay. Your email will contain a link to Klarna where you can settle your payment with your credit or debit card. If you do not pay Klarna within the grace period, late fees may apply.

Neither Klarna nor euro-star run credit searches against you that could impact your credit rating. Klarna may run a quotation search, which is an enquiry which only you, and no other companies, can see and which does not affect credit scoring.

After euro-star has sent your order, you will receive an email with payment instructions, telling you when you need to pay by, it’s typically 14 or 30 days after the order is shipped.

Payment information is processed securely by Klarna. No card details are transferred to or held by euro-star. All transactions take place via connections secured with the latest industry standard security protocols.

iDeal

iDEAL is a standard payment method for customers in the Netherlands. It makes secure online payments possible directly between bank accounts and is one of the most popular payment methods in the Netherlands. You will be redirected directly to the payment page of the bank in the online shop. In other words, this connection with iDEAL enables every Dutch visitor who has access to internet banking with a participating Dutch bank to process their payment in this way.

 

  1. Warranty and Guarantees

Unless expressly agreed otherwise, the full statutory warranty rights apply. For consumers, the statute of limitation for claims relating to defects of used goods is one year from the date such goods were received.
For business customers, the statute of limitation for claims relating to defects is one year from the transfer of risk; statutory limitation periods for recourse claims pursuant to § 478 German Civil Code (BGB) remain unaffected.
With regard to business customers, only our own information and the manufacturer's product descriptions included in the contract agreements shall be deemed to be understood as the agreed condition of the goods; we neither assume any liability for public statements made by the manufacturer nor for any promotional statements.
In case of delivered defective goods, we initially, at our sole discretion, satisfy warranty claims of business customers either by rectifying defects (repair) or by delivering articles that are free of defects (replacement delivery).
The aforementioned limitations and abridgement of deadlines shall not apply to claims for damages caused by us, our legal representatives or vicarious agents

  • - to injury to life, limb or health
  • - in cases of intentional or grossly negligent breach of duty or malice
  • - in cases of breach of essential contractual obligations that are essential for the proper execution of the agreement and the compliance, which the contracting partner may regularly expect (cardinal obligations)
  • - in the context of a guarantee promise, if applicable
  • - to the extent the Product Liability Act applies.

  1. Liability

We always assume liability for claims attributable to damages caused by us, our legal representatives or vicarious agents without limitation

  • - in cases of injury to life, limb or health,
  • - in cases of intentional or grossly negligent breach of duty,
  • - in cases of guarantee promise, if applicable, or
  • - to the extent the Product Liability Act applies.

In cases of breach of essential contractual obligations that are essential for the proper execution of the agreement and the compliance, which the contracting partner may regularly expect (cardinal obligations); in cases of slight negligence attributable to us, our legal representatives or vicarious agents, the liability shall be limited to the amount foreseeable at the time of conclusion of the contract, which can be typically expected. Otherwise, claims for damages are precluded.

 

  1. Settlement of disputes

The European Commission provides a platform for online dispute resolution (OS), which is available here https://ec.europa.eu/consumers/odr/ .
We are neither obligated nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

 

  1. Final Provisions

Our place of business shall be the exclusive place of jurisdiction for all disputes arising from contractual relationships between us, if you as a customer, acting as a merchant within the meaning of the Commercial Code, a legal entity under public law or a special fund under public law.
